VILLA OASIS GENERAL TERMS AND CONDITIONS
GENERAL
VILLA OASIS is a private house intended for rental. The owner of Villa Oasis provides and provides the highest level of service to its guests and is available 24/7 to ensure guests enjoy their stay to the fullest.
INTRODUCTION
By paying for the rental reservation in advance, you accept these general rules without reservation. The Villa Owner reserves the right to change the specified general rules, which will be published on the website, and the rules will come into force from the moment of publication. All annexes to the Holiday Home Rental Agreement will be valid only in written form.
After receiving the reservation payment, the Villa Owner will send a written confirmation of the reservation to the guest. The written confirmation of the reservation and the general terms and conditions constitute the Holiday Home Rental Agreement between the guest and the owner.
The guest must be of legal age at the time of signing the Rental Agreement.
1. START OF THE RENTAL
The confirmation contains information about the time when the Villa will be ready to receive guests. The arrival time and departure time indicated are not subject to change and the guest must adhere to the arrival and departure times. In case of early arrival, the guest will not be able to enter the Villa before the indicated time (16:00 is the indicated arrival time). The keys will be at the Villa and will be handed over to the guest only if the full amount has been paid.
The departure time from the Villa is 10:00 and the guest is obliged to hand over the keys to the owners. In case of later departure, the guest must pay all additional costs that the owner may incur and are paid by the guest upon departure.
2. VILLA OASIS
2.1. NUMBER OF GUESTS
The number of guests cannot exceed the number of guests indicated and stated in the booking confirmation. The number also applies to children regardless of age. The number of people can be changed 3 days before arrival (maximum number of people is 6). Requests for changing the number of guests must be sent to the owner.
The guest is obliged to register all persons coming to the Villa who are not stated in the Holiday Home Rental Agreement. The total number of persons in the Villa and around the Villa must not exceed the maximum number of guests indicated (6) unless the owner allows it.
If the owner finds a larger number of people in the Villa without informing them, the owner has the right to terminate the Rental Agreement immediately and the guest, as well as other guests found in the Villa, is obliged to leave the Villa within a period of 2 hours and cannot request a refund.
2.2. YOUNG GUESTS
In case the guests are under 25 years of age, they are obliged to inform the owner of the exact number of guests and their age when making the reservation. The owner has the right to refuse a group of guests who are under 25 years of age if they have not been notified of their arrival – guests are not entitled to a refund in such a case.
2.3. TENTS AND CAMPERS
It is prohibited to pitch a tent or park a camper or caravan within the Villa grounds. The owner has the right to request that the tent or said vehicle be removed immediately. In the event that the guest fails to comply with the owner’s request, the owner has the right to cancel the Holiday Home Rental Agreement and the cancellation of the Holiday Home Rental Agreement shall take effect immediately and the guest is required to leave the villa, with all other guests, within two (2) hours and is not entitled to a refund.
2.4. PETS AND ALLERGIES
Villa Oasis allows a maximum of 2 pets, which must be declared at the time of booking. No more pets are allowed than those stated in the booking confirmation.
Pet owners are responsible for the maintenance of their pets and the collection of their droppings. Pets are not allowed to sleep or lie on the Villa’s furniture. Additional cleaning costs may apply if it is determined that pets have been on the furniture.
All pets must be vaccinated against rabies and infectious diseases in accordance with EU regulations.
It is the duty of pet owners to take care of these same pets and the Villa owner does not assume any responsibility for any injury or illness of the guests’ pets. It is strictly forbidden to bathe pets in the pool.
If a guest brings a pet that was not listed when booking, the owner has the right to terminate the Rental Agreement immediately and the guest, as well as other guests found in the Villa, is obliged to leave the Villa within a period of 2 hours and no refund can be requested.
2.5. NOISE
There is a possibility that guests may hear noise from a construction site, road or similar. The owner is not responsible for this type of noise.
In the event that the guest or guests violate public order and peace and do not calm down after being warned, the owner has the right to terminate the Rental Agreement immediately, and the guest, as well as other guests found in the Villa, is obliged to leave the Villa within a period of 2 hours, and no refund can be requested.
2.6. SWIMMING POOL
The guest is obliged to follow the rules and instructions related to the use of the swimming pool (instructions can be found by the pool) for his own safety as well as the safety of other guests. The guest is responsible for using the pool. Children cannot be unsupervised in or around the pool.
The use of the counter current jet is dangerous and can cause health problems, and the guest uses it at his own risk.
2.7. HOUSE RULES
Villa Oasis has house rules that are highlighted in the Villa itself. Guests are obliged to adhere to the rules and respect them. In case of non-compliance with the rules (serious violation of the Vacation Home Rental Agreement), the owner has the right to terminate the Vacation Home Rental Agreement immediately, and the guest, as well as other guests found in the Villa, is required to leave the Villa within a period of 2 hours and cannot request a refund.
3. PRICES AND PAYMENT
Prices are quoted in Euros for a week’s stay, unless otherwise indicated. Payment is made exclusively by bank transfer.
30% advance payment of the agreed price is payable at the time of reservation, which is binding. After that, the reservation is confirmed, the owner sends the Rental Agreement and these General Terms and Conditions come into force. The vacation home rental agreement is complete when the owner of the Villa receives the advance payment. In the event that the owner does not receive the advance payment within 3 days, the Rental Agreement is canceled and the owner is able to establish a new Rental Agreement with new guests.
The accommodation price includes the following: water, electricity, internet, use of bed linen, towels, kitchen towels, final cleaning, maintenance of the pool and garden, as well as tourist tax and insurance for guests.
Payment of the remaining amount of accommodation must be made 30 or more days before the start of the Villa rental.
In case of cancellation of the reservation, the amount paid before the cancellation of the reservation will not be refunded.
For reservations confirmed 30 or more days before the start of the rental, the following conditions will apply:
a) an advance payment of 30% of the total price is payable IMMEDIATELY.
b) the remaining 70% of the amount must be paid no later than 30 days before the start of the rental.
c) in case the reservation is made 30 days before the start of the rental, 100% of the amount is payable.
3.1. PAYMENT ON TIME
The guest is obliged to make payments within the period specified above. If the guest does not comply with the payment rules, the owner has the right to terminate the Rental Agreement immediately and the guest, as well as other guests found in the Villa, is obliged to leave the Villa within a period of 2 hours and cannot request a refund.
The owner is not obliged to inform the guest about the payment, but, taking special care of the guests, will send a message (in writing) as a reminder of the payment obligation (in order to avoid cancellation of the Holiday Home Rental Agreement).
4.CANCELLATION OF THE CONTRACT AND AMENDMENTS
4.1. A completed Holiday Home Rental Agreement can only be cancelled in writing (by e-mail). Cancellation becomes effective when the owner receives the cancellation letter in writing.
4.2. In the event of cancellation of the Holiday Home Rental Agreement, all funds received up to the date of cancellation of the rental will not be returned to the guest.
4.3. In the event that the guest finds other guests as a replacement for the same period, for the same price and under the same Terms and Conditions, Vila Oasis will immediately issue a new Holiday Home Rental Agreement after receiving all necessary information about the new guests. The previously received payment of 30% of the total amount will not be returned to old guests, but the balance of 70% of the remaining amount will be charged to new guests.
In the event of a natural disaster or any accident at the Villa prior to the start of the Vacation Home Rental Agreement, the owners are not responsible for canceling the Vacation Home Rental Agreement.
5. DEPOSIT IN CASE OF DAMAGE
The guest is obliged to leave a deposit in the amount of 200 Euros upon arrival at the Villa (damage insurance). The deposit and the amount of the deposit will be indicated in the booking confirmation as well as in the Holiday Home Rental Agreement. The deposit is insurance for the owner against any damage to the Villa that the owner can pay from the deposit. In the event that the damage is greater than the amount of the deposit, the guest is obliged to pay the full amount of the damage. If no damage has been done, the owner is obliged to return the deposit to the guest during the return of the keys upon the guest’s departure.
6. DAMAGE
The guest is obliged to treat the rented Villa appropriately and with care. The guest is obliged, upon departure, to leave the Villa in the condition in which he found it. In the event of damage, the guest is liable to the owner. The owner may charge the damage from the deposit specified in the General Terms and Conditions (Article 5). If the amount of the deposit is not sufficient to cover the damage, the guest is obliged to pay the entire amount of the damage to the owner immediately.
Intentional damage or disturbance of public order is considered a serious breach of the Holiday Home Rental Agreement and the owner has the right to terminate the Holiday Home Rental Agreement immediately and the guest, as well as other guests found in the Villa, is obliged to leave the Villa within a period of 2 hours and cannot request a refund.
The guest is obliged to immediately report to the owner any damage to the Villa or around the Villa during the term of the Rental Agreement. When the guests leave, the guest and the owner will inspect the Villa and the surroundings of the Villa to determine whether or not there has been any damage.
In case there is no damage, the owner must return the deposit (Article 5 of the General Terms and Conditions).
In case additional cleaning of the Villa is required, the owner can keep the deposit.
7. DAMAGES, COMPLAINTS AND REPAIRS
In the event that the guest notices damage, dirt or any irregularity upon entering the Villa and has any complaint, he/she must report the complaint without delay and within 24 hours. A complaint regarding cleaning is filed immediately. Complaints are sent directly to the owner.
A written complaint is sent to the following address: villaoasis.kostrena@gmail.com.
It is the guest’s duty to avoid any damage.
In the event of any complaint, it is necessary to give the owner sufficient time to repair the damage.
In the event of early departure of the guests without informing the owner, the guest bears the costs and not the owner.
If the guest does not allow sufficient time to repair the damage, the Holiday Home Rental Agreement is cancelled.
8. TECHNICAL EQUIPMENT OF THE VILLA
Villa Oasis has all the necessary appliances, technical equipment and other amenities that provide a pleasant stay in the Villa. The owner is obliged to ensure excellent functionality of all the above. In the event of a malfunction of any apartment, technical equipment or anything else, the guest will inform the owner of the situation and the owner will promptly react and repair or replace the appliance or technical equipment.
9. FORCE MAJEURE
In the event that the Holiday Home Rental Agreement cannot be executed or fulfilled due to force majeure (earthquake, war, natural disaster, strike, border closure or similar), the owner may terminate the Holiday Home Rental Agreement.
10. FINAL PROVISIONS AND JURISDICTION
10.1. Villa Oasis is responsible for the accuracy of the data.
10.2. Any use of images and information from the website www.villaoasis-kostrena.eu is prohibited.
10.3. In case of violation of the provisions of this Rental Agreement, the owner has the right to terminate the Rental Agreement immediately and the guest, as well as other guests found in the Villa, is obliged to leave the Villa within a period of 2 hours and cannot request a refund.
10.4. The contracting parties may reach a solution through discussion and agreement. In the event of any dispute, the Court in Rijeka shall have jurisdiction.
